ALTITUDE ARBORISTS LLC
TERMS AND CONDITIONS OF SERVICE
By accepting an estimate, signing a proposal, authorizing work to begin, scheduling work, or making payment, the Customer agrees to the following Terms and Conditions.
1. Scope of Work
Altitude Arborists LLC ("Contractor") shall perform only the services specifically described in the written estimate or proposal. Any additional work requested by the Customer that is not included in the original estimate may be subject to additional charges and must be approved by both parties.
2. Property Access and Work Area
Customer shall provide reasonable access to the work area and ensure that driveways, gates, and access routes are available for equipment and personnel.
The Customer is responsible for identifying and disclosing any underground utilities, septic systems, irrigation systems, invisible fencing, landscape lighting, drainage systems, wells, private utility lines, or other concealed structures that may be affected by tree work or equipment access.
Altitude Arborists LLC shall not be liable for damage to underground or concealed items that were not disclosed prior to the commencement of work.
3. Tree Work Risks
Tree care, pruning, and tree removal involve inherent risks. While Contractor will exercise reasonable care and follow accepted industry standards, Customer acknowledges that tree work may result in unavoidable impacts to lawns, landscaping, gardens, flower beds, driveways, walkways, fences, and surrounding property due to equipment access, falling debris, or ground pressure.
Contractor shall not be liable for minor property impacts that occur as a normal and unavoidable part of performing the contracted services.
4. Hazardous, Dead, and Defective Trees
Customer acknowledges that dead, dying, storm-damaged, decayed, hollow, leaning, or structurally compromised trees present increased and unpredictable hazards.
Altitude Arborists LLC shall not be responsible for damages resulting from hidden defects, internal decay, root failure, structural weakness, embedded metal, insect damage, or other conditions that are not reasonably visible before or during the performance of work.
Customer understands that portions of hazardous trees may fail unexpectedly despite the use of accepted industry practices and safety procedures.
5. Chipping, Log Removal, and Debris Disposal
Unless otherwise specified in the estimate:
Brush and limbs generated from the contracted work will be chipped and removed from the property.
Logs, trunk sections, and wood debris will be removed if included in the estimate.
Wood chips may be left on-site upon Customer request.
Contractor reserves the right to determine the safest and most efficient method of processing, stacking, hauling, or disposing of wood and debris.
Additional hauling or disposal charges may apply if unforeseen site conditions require additional labor, equipment, or disposal services.
6. Heavy Equipment and Crane Operations
Certain projects may require the use of cranes, aerial lifts, skid steers, forestry equipment, trucks, trailers, or other heavy machinery.
Customer acknowledges that the use of heavy equipment may cause rutting, soil compaction, lawn damage, landscaping disturbance, driveway wear, cracked pavement, cracked concrete, or other surface impacts despite reasonable efforts to minimize damage.
Altitude Arborists LLC shall not be liable for unavoidable ground disturbance, soil compaction, rutting, landscaping impacts, driveway damage, underground utility failures, or similar conditions resulting from necessary equipment access or crane setup.
Where crane operations are necessary, Customer agrees that Contractor may select the safest crane location and work methods based upon site conditions and safety requirements.
7. Utility Clearance
Customer is responsible for informing Contractor of all known utility locations and concealed structures.
Contractor shall not be responsible for damage to:
Irrigation systems
Invisible pet fences
Landscape lighting
Septic systems and components
Wells and well lines
Drainage systems
Water lines
Private utility lines
Underground cables
Any concealed structure not visibly apparent or disclosed before work begins
8. Weather and Scheduling
Tree work is weather dependent and may be delayed due to rain, wind, snow, ice, equipment issues, safety concerns, emergency work, or other unforeseen circumstances.
Estimated scheduling dates are approximate and are not guaranteed.
Altitude Arborists LLC reserves the right to postpone work when conditions are deemed unsafe.
9. Cleanup
Unless otherwise specified in writing:
Brush and limbs generated from the contracted work will be chipped and removed.
Logs and trunk wood will be removed if included in the estimate.
Fine sawdust, leaves, wood particles, and minor debris may remain after completion.
Contractor is not responsible for restoring lawns, landscaping, turf, soil conditions, or ground surfaces disturbed during normal operations unless specifically included in writing.
10. Change Orders
Any work requested beyond the original proposal must be approved by the Customer and may result in additional charges.
Verbal approval by the Customer or their authorized representative shall constitute authorization for additional work.
11. Payment Terms
Payment is due upon completion of work unless otherwise agreed in writing.
Invoices unpaid after thirty (30) days may accrue interest at the rate of 1.5% per month (18% annually), or the maximum amount permitted by law.
Customer agrees to pay all reasonable collection costs, attorney fees, court costs, and expenses incurred in collecting overdue balances.
Altitude Arborists LLC reserves the right to require deposits for certain projects.
12. Ownership and Authorization
Customer warrants that they are the property owner or have authority from the property owner to authorize the contracted work.
Customer agrees to indemnify and hold harmless Altitude Arborists LLC from any claims arising from unauthorized work requests or disputes regarding property ownership.
13. Limitation of Liability
To the fullest extent permitted by law, Contractor's total liability for any claim arising out of services performed shall not exceed the amount paid by Customer for the specific services giving rise to the claim.
Under no circumstances shall Contractor be liable for indirect, incidental, special, consequential, or punitive damages, including loss of use, loss of property value, business interruption, or lost profits.
14. Force Majeure
Contractor shall not be liable for delays or failure to perform caused by circumstances beyond its reasonable control, including severe weather, natural disasters, labor shortages, equipment failures, government actions, or other events beyond Contractor's control.
15. Warranty
Altitude Arborists LLC warrants that services will be performed in a professional and workmanlike manner consistent with accepted industry standards.
No other warranties, express or implied, including warranties of merchantability or fitness for a particular purpose, are provided.
16. Photography and Documentation Authorization
Customer authorizes Altitude Arborists LLC to photograph, video record, and otherwise document the property, trees, equipment, and work site before, during, and after the performance of services.
Such documentation may be used for:
Project records
Insurance documentation
Safety reviews
Employee training
Quality control
Dispute resolution
Marketing and advertising purposes, including websites, social media platforms, print materials, and promotional content
Altitude Arborists LLC agrees not to intentionally publish personal identifying information or private customer information without permission.
Customer grants Altitude Arborists LLC a non-exclusive right to use photographs and videos of the work performed for business purposes without additional compensation.
17. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Maine.
18. Acceptance
Acceptance of an estimate, electronic approval, signature, payment of a deposit, scheduling of work, or authorization to begin work constitutes acceptance of these Terms and Conditions.
Customer Acknowledgment
Customer acknowledges and understands that tree work is inherently hazardous and may require the use of cranes, aerial lifts, skid steers, trucks, trailers, and other heavy equipment. Despite reasonable precautions, tree work may result in lawn disturbance, rutting, soil compaction, landscaping impacts, driveway wear, and other incidental property effects associated with the safe performance of the contracted services.
Customer further acknowledges that dead, diseased, storm-damaged, hollow, or structurally compromised trees may behave unpredictably and that Altitude Arborists LLC cannot guarantee against all damage resulting from hidden defects or conditions not reasonably visible prior to or during the performance of work.
By signing below, Customer confirms that they have read, understood, and agreed to these Terms and Conditions.
